FINCA EL PARAÍSO is responsible for the processing of personal data.

When customers supply us with their personal data, no matter by which means, they accept this processing in accordance with the terms of our Privacy Policy.

FINCA EL PARAÍSO is a Colombian Hotel Service (Prestadora de Servicios de Hospedaje) identified by tax identification number (N.I.T.) 901099369-6. FINCA EL PARAÍSO is responsible for processing of personal data of its customers in accordance with Law 1581 of the 17th October 2012 and Decree 1377 of the 27th June 2013. This notice informs ‘data owners’, that is, natural persons whose personal data is provided to FINCA EL PARAÍSO, that their personal data will be added to our database once they begin a commercial relationship with our hotel. Types of personal data in our database: The following personal data is stored in our database and treated according to our objectives and Privacy Policy:

The personal data provided to FINCA EL PARAÍSO will remain as part of our database for as long as is required for FINCA EL PARAÍSO to fulfil its legal and/or contractual obligations. This includes fiscal and accounting obligations, as well as provisions applying to administration, accounting, tax, and legal and historical issues.
We assume that all personal data provided to us is truthful. We do not seek to verify, nor do we assume responsibility for verifying, the authenticity or validity of the data provided to us.

Please note that those who sign up to the FINCA EL PARAÍSO Newsletter will not have their personal data passed on to third parties. Once the following Privacy Policy has been accepted, the client authorises our affiliates, employees and suppliers to contact them with information on products and services. This includes any offers which may be of interest to our affiliates. The client may be contacted by email, text message, or other means.

DATA SECURITY

We have established policies, procedures and standards as per data security. The objective of these is to protect and preserve the integrity, confidentiality and availability of this data. This will occur independently of the medium or format of that data, whether it is stored temporarily or permanently, or the form in which that data is transmitted. Third parties contracted by FINCA EL PARAÍSO are also obliged to adhere to and comply with our practices, procedures, standards and data security manuals. Any and all contracts with third parties (contracters, employees, external consultants, temporary associates, etc.) which involve the processing of personal data and information will include a confidentiality agreement detailing the commitments of these third parties. These commitements concern the protection, proper care, security and preservation of the confidentiality, integrity and privacy of the aforementioned data.

RIGHTS AND PROCEDURES

Colombian law grants clients the following rights as data owners:

  1. To view, update and rectify personal data stored by the entity responsible for or charged with data processing.
  2. To request the proof of authorisation provided to the individual responsible for processing personal data, with the exception of cases in which that proof of authorisation is not required.
  3. To be informed on request by those responsible for or charged with processing personal data as to the use of that data.
  4. To file complaints with the Industry and Commerce Superintendence (SIC; Superintendencia de Industria y Comercio) in the event that data protection rules are violated.
  5. To revoke authorization and/or request the deletion of personal data as per Law 1581 of 2012.
  6. To access processed personal data, free of charge, once per month, as per the terms of the regulatory framework in force.

The procedure for exercising these rights is the following:

PROCEDURES FOR ENQUIRIES

Data owners, authorised persons or other persons concerned can consult the personal data stored in our database. FINCA EL PARAÍSO will provide clients with the requested information once we have established the legitimacy of the request. This information will be provided within a maximum of ten (10) working days, calculated from the date of the receipt of said request. If it is not possible to provide this information within the abovementioned period, clients will be informed of the reason for delay, as well as the new date on which information will be provided. If data owners or authorised persons require that items within our database be corrected, updated or deleted, or if they feel that FINCA EL PARAÍSO has not fulfilled its data obligations under Colombian law, they may file a complaint. This complaint will be processed in accordance with the following regulations:

Clients’ complaints should be sent directly to FINCA EL PARAÍSO and include the following information: clients’ identification document number(s), reason for complaint, clients’ address, as well as any accompanying documentation specific to the case. If the complaint does not contain the aforementioned information, FINCA EL PARAÍSO requires clients to send the missing information within five (5) days so that the original complaint may be rectified. In the event that two (2) months pass from this extended deadline without FINCA EL PARAÍSO receiving the required information, FINCA EL PARAÍSO will consider the complaint withdrawn.

In the event that FINCA EL PARAÍSO is unable to resolve a client’s complaint, that complaint will be passed on to the relevant authorities in a maximum of two (2) working days. The client will be informed of this as soon as possible.

Where appropriate, once the completed complaint has been received, a note reading “complaint pending” in the FINCA EL PARAÍSO database. It will take no more than two (2) working days for us to include this note in our database; it will remain on the database until the issue behind the complaint is solved.

FINCA EL PARAÍSO must respond to all complaints within a maximum of fifteen (15) working days of their receipt. If it is not possible to respond to the complaint within the aforementioned time period, claimants must be informed of the reasons for the delay, which may not, under any circumstances, last for more than eight (8) working days after the initial fifteen (15) working day period has ended.

MODIFICATIONS AND VALIDITY

FINCA EL PARAÍSO may modify the terms of this Privacy Policy at any time. Customers will be informed of any modification through our website, where a revised version of our Privacy Policy will be published. The database is valid indefinitely.
