TERMS AND CONDITIONS OF PURCHASE
1: Our Aim
We wish to provide our clients with the terms, conditions and policies of purchase at FINCA EL PARAÍSO, Yopal. In doing so, we will fulfil all the necessary legal requirements for hotels. These terms and conditions must be accepted prior to purchase. Examples of terms and conditions include the specifics of the reservations, additional taxes, entry fee, check-out and check-in, cancellation, as well as additional services and policies. All guests must be of full legal capacity to agree to the following terms and conditions. All personal data and information provided by clients must be factual. All clients must accept the following terms and services; if they choose not to do so, their purchase will be considered invalid.
2: APPLICABILITY
Clients must be above the age of eighteen and of full legal capacity to reserve with us.
TERMS AND CONDITIONS OF ACCOMMODATION
3.1. Check-in and check-out policy
All reservations begin at 15:00 (3pm) Colombian Time of start-date of the reservation; they finish at 13:00 (1pm) Colombian Time of the end-date of the reservation. Additional charges will apply to any guest who checks out more than one (1) hour past the stated check-out time.
3.2. Cancellation and alteration policy
Guests may cancel or alter their reservation 72 hours before their stay is due to begin. To do so, they must send their bank details to reservas@elparaiso.co . Refunds will be provided by FINCA EL PARAÍSO in 10 to 15 working days. Administration costs (10% of the total price of the reservation) are non-refundable in the event of cancellation. No additional charges apply to guests who wish to alter their reservation in the off-season, providing that accommodation is available on the desired dates.
Should a guest wish to alter the date of their reservation, they must inform FINCA EL PARAÍSO thirty (30) calendar days before said reservation is due to begin. Guests may not alter the date of their reservation in peak tourist season; refunds cannot be offered less than thirty (30) days before the reservation is due to begin. The total refund provided may depend on the new date of the reservation. Once the reservation has been cancelled, FINCA EL PARAÍSO may do as they wish with the previously booked room on the previously booked dates.
3.3. Registration policy for those under the age of eighteen
Any guest whose party includes persons under the age of eighteen must provide FINCA EL PARAÍSO with the identification document of said person, as well as proof of their family relationship to that person. If persons under the age of eighteen are traveling without their parents, the guest must also provide notarised proof of parental permission to reception, including a copy of parents’ identification documents. Without all of the following documentation, those under the age of eighteen will not be permitted to stay at FINCA EL PARAÍSO. We therefore comply with Law 679 of the 2001 Colombian Statute to Prevent the Sexual Exploitation of Boys, Girls and Adolescents.
3.4 Reservation Policy for Foreign Residents
Foreign guests who wish to reserve a room at FINCA EL PARAÍSO, including all foreign persons under the age of eighteen, must present their identification documents and those of their party to reception. These documents may be passports or equivalent documents. As such, guests comply with the law of Colombia as regards their stay in the country.
3.5. Early Check-In Policy
FINCA EL PARAÍSO does not guarantee check-in at any time earlier than 15:00 (3pm), except under the following conditions:
- When guests have written permission for early check-out on a given day.
- If early check-in occurs after 09:00 (9am) on the day of the reservation, access to the room will be considered a courtesy of the hotel. Guests accept that if FINCA EL PARAÍSO agrees to an early check-in, additional charges may apply.
These charges are stipulated below;
- Before 06:00 (6am) on the day of the reservation, the full price of the previous night will be charged. This includes breakfast charges if included in the following days’ reservation.
- Between 06:00 (6am) and 09:00 (9am) on the day of the reservation, half of the price of the previous night will be charged.
3.6. Early Check-Out Policy In the off-season, guests accept the following:
- They must inform FINCA EL PARAÍSO of early check-out at least one (1) day before the new departure date. As such, FINCA EL PARAÍSO can make the room available to other potential guests.
- In the event that clients do not inform FINCA EL PARAÍSO one (1) day in advance of their new departure date, they accept to pay the value of one night of their stay. Please be aware that in peak tourist season, there is no early check-out policy.
3.7. Late Check-Out Policy Guests accept the following:
- All of the following is subject to availability.
- Guests can request late check-out until 15:00 (3pm) on the day of check-out.
- Without exception, guests who check out between 15:00 (3pm) and 18:00 (6pm) will be charged half of the price of a full night of accommodation, calculated in accordance with the previous night of accommodation.
- Without exception, guests who check out after 18:00 (6pm) will be charged the full price of a full night of said guests’ reservation, calculated in accordance with the previous night of accommodation.
3.8. Additional Reservation Policies. FINCA EL PARAÍSO accepts no responsibility for the following:
- Being unable to provide services, whether in part or in full, in the following cases: force majeure, unforeseen circumstances, unforseeable or insurmountable actions taken by third parties or guests, lack of internet service, inability to access our website, computer viruses, and the inability of a guests’ bank to verify their payment.
- Equally, any payment or reservation that is irregular, incomplete, invalid or fraudulent, will result in the cancellation of the client’s reservation or request, without prejudice to all necessary legal actions against the client or guest.
- Once the reservation is complete, the client or guest is entirely responsible for the accuracy of all of the information that they provide. Any inconsistency in this information will result in the cancelation of the reservation.
4. POLICIES PERTAINING TO SPECIFIC LEGAL CIRCUMSTANCES
4.1 Anticorruption and Antifraud Policy
FINCA EL PARAÍSO neither permits, nor accepts, nor practices dishonest personal and business practices. These include accepting or offering gifts, invitations, or other types of incentives which might serve to compensate for or influence an individual to refrain from taking a given business or legal means. Neither do we conceal, alter, falsify or omit information for personal gain, the benefit of others; we declare all possible conflicts of interest which might result in putting our personal interest before collective interests. We promote an ethical, transparent business practices in all of our activities.
4.2. Policy on the Prevention of Asset Laundering and the Financing of Terrorism
FINCA EL PARAÍSO is conscious of its responsibility in the fight against Asset Laundering and the Financing of Terrorism. It therefore promotes and complies with all necessary efforts and legal means to prevent and avoid these illicit acts. It does so not only for reasons of personal conviction and business ethics, but for fundamental reasons of responsability, ethics, respect for the law and state organs. We comply with national and international leglislation and regulation in this area.
As a result, FINCA EL PARAÍSO requires all guests to declare under oath that no part of their wealth is obtained from asset-laundering, the finance of terrorism, drug-trafficking, kidnapping, or other illegal forms of income. This legal requirement is undertaken as part of the reservation process. This applies to all illicit activities under Colombian law or international treaties. By the same token, the guest or client confirms that all payment for servcies provided by FINCA EL PARAÍSO has been gained exclusively by legal means. Further, the guest or client permits FINCA EL PARAÍSO to report any anomaly or suspected infraction in reservation or payment to the competent authorities. It is incumbent upon the guest or client to provide accurate information while completing their reservation. This includes the guest’s name, their profession and source(s) of income. Guests must also confirm that any businesses they may manage or own, any shares they might have, or any investments they may have made, are all fully legal. This declaration is considered to have been made as part of the acceptance of the terms and conditions of this contract.
5. ENVIRONMENTAL AND WILDLIFE POLICY
5.1. Sustainability Policy
FINCA EL PARAÍSO is commited to the sustainable development of its land. It accepts all environmental, sociocultural and economic requirements in the area of environmental law. We care for and improve our environment and expect our guests to do the same. As a result, we comply with all relevant laws relevant laws in an attempt to minimise our impact on the environemtn. We invite our guests, clients, suppliers, employees and partners to do the same.
5.2. Wildlife Policy
FINCA EL PARAÍSO works to protect the flora and fauna of Colombia. For this reason we do not permit the purchase or trafficking of endangered species of animals or plants, or any product of these species of animal or plant. We do not permit any activity which contravenes Law 1333 of 2009 on flora and fauna.
5.3. Policy on Tobacco
In accordance with Law 1335 of 2009, FINCA EL PARAÍSO is a tobacco-free area. As a result, guests are not permitted to smoke in private, social or enclosed areas. These include rooms, corridors, restaurants, bathrooms and living spaces.
6. PET POLICY
6.1. Pet Friendly Policy
We are a pet-friendly hotel. We know how imporant pets are to you and your family; however, FINCA EL PARAÍSO must comply with Law 1801 of 2016 (CNPC) and other relevant laws. As such, pet breeds considered as dangerous under the aforementioned laws cannot be accepted on our hotel grounds.
All pet breeds that are not considered as dangerous under the aforementioneds laws are permitted on our hotel grounds. There is no extra charge for pets. Please note that for reasons of cleanliness pets are not permitted entry to the swimming pool or kitchen. In social areas, they must be accompanied by an owner over the age of eighteen years. Failure to comply with these rules will result in a fine of 250,000 Colombian pesos or the equivalent in USD.
As a result, all pets must be kept under the supervision, care and control of the signee of this document. Any noise made by pets, as well as any other action which affects or harms other guests or employees, as well as damage to hotel installations, equipment, vehicles or any other hotel product, is the exclusive responsibility of the signee. They therefore accept to pay for any damage or fine.
7. PERSONAL DATA AND INFORMATION POLICY
7.1. Authorisation of Personal Data and Information Processing .
The guest allows FINCA EL PARAISO to process any personal data or information provided. This information may be provided through websites, call centers, and other means. FINCA EL PARAÍSO informs all guests that their data will be treated with utmost care in accordance wirth Law 1266 of 2008, Law 1581 od 2012, Decree 1377 of 2013, as well as other relevant national legislation.
8. ADDITIONAL RESERVATION POLICIES
8.1. Information received and accepted by the guest or client.
The guest confirms that they have received all necessary information as regards their reservation from FINCA EL PARAÍSO. This includes but is not limited to terms and conditions, validity, price, any changes thereof, as well as the duration of stay. Furthermore, it includes all information related to hotel installations, services and location, all of which are available through our website, over the phone, or by other means of communication. Any purchase made through our website, over the phone, or via any other electronic medium, presupposes the acceptance by client or guest of all of FINCA EL PARAÍSO’s terms and conditions.
All reservations are personal and cannot be transferred to a third party under any circumstance. They cannot be sold, gifted or awarded to any other individual or party.
8.2. Registration, charges, guarantees and commitments of stay or accommodation at FINCA EL PARAÍSO.
The client or guest accepts the following:
- In accordance with Colombian law as per tourism and hotel services, as well as the terms and conditions of this contract, all clients and guests must fill in a registration card or document upon their arrival at the finca. The following information must be included in that card or document: their identity card number, permanent address, occupation, mobile telephone number and other information required by Colombian law. If traveling with pets, record must be made of this. The hotel must be informed of the breed of the pet and accept the conditions of accommodation as per pets.
- The price of the reservation is dependent upon the type of room or cottage, number of guests, the date and time of check-in and checkout, amongst other conditions.
- The price of the reservation includes all taxes required by the hotel and restaurant service of Colombia at the time of payment.
- The client or guest must provide FINCA EL PARAÍSO with the details of an authorised credit or debit card at the time of payment. The aforementioned card will serve as a guarantee of payment of the reservation as well as other charges. In other cases, payment may be made by signed voucher.
- If a guest or client reserves various rooms or cottages using a single credit or debit card or payment platform, that payment card must be used as a security deposit for all of the rooms or cottages reserved by that client or guest.
- If the guest or client pays in a currency other than the Colombian Peso, the total price of the reservation will be determined by the official exchange rate.
- The price of the reservation does not include any services which are not explicitly stated. As a basic guide, the price of the reservation is limited to the value of accommodation.
- Clients or guests must use their room in a respectful and responsible manner. As a result, any conduct that is contrary to the norms of living with other guests will result in the cancellation of clients’ or guests’ reservation without compensation. In the event that the full reservation of a given client or guest has not been paid, the remaining nights of the stay must also be paid in full. Further legal action may be taken if necessary.
FINCA EL PARAÍSO offers WiFi free of charge. As a result of our location, however, we are unable to guarantee regular service. Under no circumstances may guests use our WiFi service to publish, spread or communicate that which is illegal under Colombian law; neither may they reproduce copyrighted material without the express permission of the copyright-holder. Guests are also required to comply with the security policy of our internet provider, the objective of which is to prevent the use of the internet for illegal means.
8.3. Applicable regulations and acceptance of terms and conditions
In the event of any dispute between guest and FINCA EL PARAÍSO, this contract will serve as the legal basis on which all decisions by the Colombian legal authorities will be made. Legal complaints will first be heard by the Court of Arbitration of the Chamber of Commerce of Yopal (Tribunal de Arbitramento de la Cámara de Comercio de Yopal). In the event that no resolution can be found, the case will be presented before the competent ordinary jurisdiction.
The client or guest accepts the terms and conditions of this contract in full. They confirm that they have read and understood the aforementioned conditions in their entirety. By accepting the reservation, they give full legal validity to said terms and conditions.
